THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 130 OF 2012 O R D E R:

This Company Petition has been filed seeking winding up of the respondent Company.

Though notice was ordered, the same was not served on the respondent. Therefore, on 08.10.2013, this Court admitted the Company Petition and on 06.11.2013, this Court directed publication of the admission of the Company Petition and that on 04.12.2013, it was reported that notice was published and in spite of the same, there is no response. Therefore, on 13.11.2018, this Court directed the learned counsel for the petitioner to get instructions whether his client would further desire to pursue the Company Petition, particularly considering the fact that the respondent is a small scale industry and as per the Bank, there were hardly any assets available with the respondent. Today, when the matter is taken up, learned counsel for the petitioner submits that the Company Petition may be closed leaving it open to the petitioner to work out the remedies as are available to it under law, including those under Section 138 of the Negotiable Instruments Act.

Recording the above submission, the Company Petition is closed leaving it open to the petitioner to work out the remedies
