HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.1084 of 2017 ORDER :

Aggrieved by the order dated 13.03.2017 in Crl.MP.No.96 of 2017 in Crl.MP.No.1 of 2015 in M.C.No.1 of 2015 passed by the Special Magistrate of First Class, Sullurpet, this revision is filed by the petitioner, who is son of respondent No.1 herein. Heard.

The Criminal Revision Case is disposed of before admission and before notice to respondent No.1, by suspending the N.B.W. pending, for two months and in the mean time the revision petitioner shall pay the arrears of interim maintenance, failing which the order ceases its force after two months from today. Needless to say, any amount towards interim maintenance ordered to be paid is to be withdrawn by respondent No.1 herein. However, for adjustment subject to the final result of the quantum of maintenance to be awarded and subject to that and with a direction to the lower Court to dispose of the main M.C. from the parties present and the proceedings are summary in nature, within three months from the date of receipt of copy of this order. The lower Court is further directed to grant any

certified copies sought for by the revision petitioner in the mean time. The revision petitioner is directed to pay the arrears of maintenance in three equal installments from today. Any nonpayment of the first installment due by 18.05.2017 entitles execution by ceasing the operation of suspension of the pending N.B.W. without any further reference to this Court. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
