THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4023 of 2019 ORDER:
This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner/A.1 seeking to quash the order dated 24.04.2015 passed in C.C.No.177 of 2015 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad.

Heard learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

The petitioner is arrayed as A.1 in C.C.No.177 of 2015 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad. Since the petitioner/A.1 was absent on 24.04.2015 before the trial Court, NBW was issued against him. Challenging the same, the present petition is filed.

Issuance of NBW is to secure the attendance of the petitioner/A.1 before the trial Court.

The Criminal Petition is disposed of directing the petitioner/A.1 to surrender before the trial Court within ten days from today and make an application for recalling of NBW pending against him. On filing such an application, the trial Court shall consider the same and pass appropriate orders in accordance with law. Till such time, no coercive steps shall be taken against the petitioner/A.1. The petitioner/A.1 is further directed to appear before the trial Court on each and every date of adjournment.
Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
