THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 12173 of 2015 ORDER:

Aggrieved by the inordinate delay in granting house site patta by the 2nd respondent-District Collector, Karimnagar, the petitioner filed this writ petition.

2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader.

3. The petitioner, an octogenarian and the wife of one late Rajaiah, who was a Freedom Fighter, states to have made applications to the District Collector, Karimnagar on 10.01.2014, 24.09.2014 and 13.12.2014 requesting grant of house site patta. She states that she is in receipt of Freedom Fighters' Pension and as per G.O.Ms.No.185, Revenue (Assignment.I) Department, dated 11.03.1997, she is eligible for a house site patta. It is also stated that a similarly situated person by name Samala Mallaiah filed W.P.No.30520 of 2014 and two other persons filed W.P.No.22694 of 2013, wherein this Court directed the District Collector concerned to consider their cases in accordance with law; and consequent to the said direction, the District Collector, Warangal had allotted house site to Samala Mallaiah, a resident of Warangal. The writ petitioner prays for a similar relief in her case as well.

In the circumstances, the 2nd respondent-District Collector, Karimnagar, is directed to consider the representations made by the petitioner for grant of house site patta in the light of G.O.Ms.No.185, Revenue (Assignment.I) Department, dated 11.03.1997 and pass appropriate orders, in accordance with law, as expeditiously as possible, preferably within four months from today.

5. Accordingly, the writ petition is disposed of. No costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
