HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.6110 OF 2015 ORDER:

This Writ Petition is filed questioning the inaction on the part of the respondents in not considering the petitioner's representation dated 14.02.2014 for issuance of the duplicate passbook and title deeds of Sy.No.202/23-1 to an extent of Ac.0-44 cents situated at Kamepally village of Santhamgula Mandal, Prakasam District.

Petitioner claims to be pattadar of land to an extent of Ac.0-44 cents situated in Sy.No.202/23-1 of Kamepally Village, Santhamgula Mandal, Prakasam District. It has been submitted in the application dated 14.02.2014 made to the 5th respondent, seeking issuance of duplicate copy of pattadar passbooks and title deeds as he lost the same while travelling in the RTC bus from Kamepally to Santhamaguluru X roads on 15.01.2014. After 14.02.2014, once again on 25.07.2014 petitioner approached the 5th respondent-Tahasildar and also complied with all the formalities required under Sec.31 of A.P. Rights in Land and Pattadar Passbook Act, 1971 (in short "the Act") for issuance of duplicate pattadar passbook and title deeds. Though more than six months passed, no steps have been taken by the respondents.

The grievance being of the simple in nature and the authorities have statutory obligation to issue duplicate pattadar passbook, once again the 3rd respondent-District Collector is directed to comply the formalities for issuance of duplicate pattadar passbook and title deed to the petitioner within a period of eight (08) weeks from the date of receipt of this order. If there is any deficiency in the application made by the petitioner in complying with the requirements under Rule 31 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Rules, 1989, they shall be communicated to the petitioner by Registered Post with Acknowledgment Due.

With the above direction, the Writ Petition is disposed of at the admission stage. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
