THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36276 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in interfering with the petitioner's "Batch Mix and Hot Mix Drum Plant 100HPEM" in the name and style of Sri Lakshmi Venkateswara Constructions in Survey No.267/1 of Bhanumukkala Village, Banaganapalle, Kurnool District, in spite of the petitioner having all the relevant documents and permissions and the Memo dated 17.09.2016 of the third respondent and consequently, to direct the fourth respondent not to interfere with the petitioner's affairs.

Heard and perused the material.

Learned counsel for the Assistant Government Pleader for Home (Andhra Pradesh) and the learned counsel for the respondents 2 and 3 submits that respondents 2 and 3 sought the help of the fourth respondent herein with an intention to discharge the lawful duties. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the fourth respondent not to interfere in any of the affairs of the petitioner without therebeing any case registered against the petitioner herein. It is made clear that this order will not stand in the way of the fourth respondent in assisting the officials in discharging their duties as per the provisions of the Statute. The fourth respondent is also directed to act in accordance with law. The writ petition is accordingly disposed of.
