THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6826 of 2015 ORDER:

A perusal of the writ affidavit reveals that the allegations, predominantly, are that the respondents 6 and 7 are trying to utilize the official machinery to coerce the petitioners to part with the residential property in favour of respondents 6 and 7. The petitioners' counsel contends that the petitioners have complained to the Superintendent of Police, who in turn endorsed the complaint to the Station House Officer-4th respondent.

2. The material on record reveals that essentially it is a dispute between the petitioners and respondents 6 and 7. However, when the petitioners filed a complaint with the Superintendent of Police making allegations of threatening and intimidation, which complaint was endorsed to the Station House Officer, a duty is cast upon the 4th respondent to register a case and enquire into the matter. There is no reason for this Court to believe that the 4th respondent would not take any action based on the complaint of the petitioners. Insofar the injunctive relief sought by the petitioners against respondents 6 and 7, such relief cannot be granted in a writ petition; and the petitioners may approach competent civil Court.
