HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 4162 OF 2019 ORDER:
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') is filed by the petitioners - accused Nos.1 and 2 viz., Syed Afzal Ahmed and Dr. Syed Arafath Ahmed, respectively, seeking to quash the proceedings against them in C.C. No.159 of 2018 on the file of the learned II Additional Judicial Magistrate of First Class, Mancherial.
2. Charge sheet came to be filed against the petitioners for the offences punishable under Sections 447, 427, 323 and 506 of the Indian Penal Code, 1860, in Crime No.56 of 2017 dated 03.02.2017 of Mancherial Police Station, Mancherial District.
3. Though the present criminal petition is filed seeking to quash the entire proceedings, learned counsel for the petitioners restricts the prayer seeking to dispense with the presence of the petitioners before the trial Court on every date of adjournment.
4. Learned Public Prosecutor submits that since identity of the petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.
5. Having regard to the facts and circumstances of the case, personal appearance of the petitioners in C.C. No.159 of 2018 on the file of the learned II Additional Judicial Magistrate of First Class,
Mancherial, is hereby dispensed with except on the dates when their presence is specifically required by the trial Court.
6. With the above directions, the Criminal Petition is disposed of.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
