HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.7303 OF 2011 ORDER:

This writ petition is filed by the petitioner seeking to direct the respondents to take necessary action against Syed Khaja and his associates in accordance with law.

The case of the petitioner is as follows:

The petitioner along with his younger brother and wife went to Pochamma Maidan, Warangal, on 19.9.2010 to participate in a panchayat held by Syed Khaja and others. In the said panchayat, the said Syed Khaja demanded the petitioner to deposit a sum of Rs.5,000/- to resolve the matter, for which the petitioner opposed. Then, the said Syed Khaja and others abused the petitioner in filthy language and attacked him with an intention to kill him. The petitioner approached the 2nd respondent and lodged a complaint against the said persons. As no action was taken, the petitioner filed a private complaint before the Magistrate concerned and the said complaint was referred to the 2nd respondent. After registration of a case in Crime No.251 of 2010 for the offence under Sections 323, 324, 499 and 420 r/w 34 IPC, the 2nd respondent has not arrested the said Syed Khaja and others and further, he has not added Section 307 IPC in the FIR and he has not filed any charge sheet.

Perused the material available on record.

The learned Government Pleader for Home submitted that the police officials are investigating into the matter and after completion of the investigation, they will file a final report before the Court concerned.

Considering the circumstances of the case and the submission made by the learned Government Pleader, the Writ Petition is disposed of with the following direction:

"The respondents are directed to complete the investigation and file a final report, if any, as expeditiously as possible." No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed.
