With the consent of both the parties, this Writ Petition is disposed of at the stage of admission.

The petitioner alleges that without following the due process, his property was demolished and the same is ex facie illegal. 3.

Learned Standing Counsel for Greater Hyderabad Municipal Corporation, on instructions, submits that the petitioner encroached the public road and therefore encroached portion was removed, as the same is obstructing widening of the existing road. He would fairly submit that no prior notice was issued to the petitioner and seeks leave of the Court to cause notice on the petitioner to take further course of action, after consideration of explanation, if any, submitted by him.

Recording the said submission, the Writ Petition is disposed of granting liberty to the 2nd respondent to take further course of action, as warranted by law, by causing notice on the petitioner, consider his explanation, if any, submitted, and pass a reasoned order in support of the said decision. Till a notice is issued, explanation of the petitioner is considered and a reasoned order is passed by the 2nd respondent, no coercive action shall be taken against the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
