THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.11299 of 2017 ORDER: (per SK,J) By way of this writ petition, the petitioner seeks to assail the action of the authorities in not considering his representation dated 21.05.2011 for the purpose of calculating his retirement benefits for the period from 11.02.1984 to 16.03.1996.
The petitioner earlier filed O.A.No.4735 of 2015 seeking a declaration that the action of the authorities in not counting the service rendered by him from 11.02.1984 to 16.03.1996 and from 16.03.1996 to 02.09.1996 for the purpose of full pension and pensionary benefits was illegal and sought a consequential direction to count the said period of service and calculate the full pension and pensionary benefits thereupon. By order dated 18.08.2015, the Tribunal directed the authorities to consider the representations of the petitioner dated 21.05.2011 and 08.02.2013 and pass appropriate orders within a time frame. It appears that the Government of Telangana vide Memo dated 05.11.2015 considered the petitioner's representations in terms of the order dated 18.08.2015 passed by the Tribunal in O.A.No.4735 of 2015 and rejected the request.
That being so, the prayer in this writ petition again seeking reconsideration of the representation dated 21.05.2011 without challenging the rejection of the same vide Memo dated 05.11.2015 is utterly misconceived. It is expected that the learned counsel appearing for the parties would take a little trouble while espousing the cause of their clients and frame their prayers properly.
However, in the present case, the learned counsel has not lived up to this expectation.
The writ petition is accordingly dismissed on this short ground leaving it open to the petitioner to take recourse to appropriate remedies in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
