HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4237 of 2011 ORDER:

This writ petition is filed praying to grant the following relief : "To issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the action of the 1st respondent in not continuing the petitioner in service as TB HV (TB Health Visitor) in any one of the vacancies on contract basis along with others as per the guidelines of the District TB Control Society as highly illegal arbitrary and consequently to direct the 1st respondent to continue the petitioner in service as TB HV on contract basis in the 1st respondent society."

2. This Court by order dated 08.03.2011 after noting the rival submissions, directed the respondents to take appropriate decision on the claim of the petitioner for continuation of service and availability of vacancies.

3. When the matter is taken up, learned counsel for the petitioner submits that by proceedings dated 05.04.2011 the respondents have informed the petitioner that there is no PHC at Mangalagiri and there are no vacancies at Piduguralla or at District TB, Control Center, Guntur (DTCO).

4. In view of the subsequent developments, the cause in the writ petition does not survive.

5. Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
