537 of 2019 against the Petitioners/Accused No.1 to 4 on the file of the Judicial Magistrate of First Class at Manuguru pending disposal of the quash petition and pass This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Nageswara Rao Repakula, Advocate for the Petitioners and of Sri M. Vivekananda Reddy, learned Asst. Public Prosecutor on behalf of the Respondent No.1 and Sri M.V. Venu, Advocate on behalf for Respondent No.2.

THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4523 OF 2O2O ORDER:

This Criminal Petition is filed under Section 492 of I Cr.P.C., by the petitioners/accused Nos. 1 to 4, to quash the proceedings in C.C.No.537 of 2Ol9 on the file of the Judicial Magistrate of First Class, Manuguru.

2. Heard learned counsel for the petitioners and Sri M.Vivekananda Reddy, learned Assistant public Prosecutor for the respondent No.l - State. perused the record.

The 2"d respondent lodged a complaint alleging that she was married to the 1"r petitioner/accused No. 1, and thereafter, accused No.l and his family members started harassing her. They also suspected her when she was pregnant.

During tJle course of trial, the trial Court can consider these aspects to determine their correctness. 5.

l.earned counsel for the petitioners contined his prayer to dispense u'ith the personal appearance of the petitioners.

Considering the submission of learned counsel for the petitioners, the attendance of the petitioner Nos. 1 to 3/accused Nos. 1 to 3 herein is dispensed with, subject to the following conditions:

i) Petitioner Nos.l to 3 shall always be represented by the counsel on record.

ii) They shall file an aflidavit stating that, in their absence, the proceedings conducted by the counsel will not be disputed by them in any manner, and they shall not dispute their identity also.

iii) They sha1l appear before the learned Magistrate as ald when their presence is required. In the event of the petitioners failing to appear when the Court directs, this order dispensing their attendance shall stand cancelled. 7.

Accordingly, the Criminal Petition is disposed of. The trial Court is directed to conclude the trial as expeditiously as possible, preferably within 6 months from the date of receipt of a copy of this order.
