St. Marys Educational Society, v. The National Council For Teacher Education,
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19653 of 2016 O R D E R:
This writ petition is filed by the Petitioner-Educational Society seeking issuance of writ of mandamus declaring the order of the 1st respondent, dated 18.04.2016, confirming the orders of the 2nd respondent, as null and void, and contrary to the provisions of the National Council for Teacher Education Act, 1993 (for short 'the Act'), and consequently to direct the 2nd respondent to consider the petitioner's application for running the two years course of 'D.EI.Ed-AI" , for the academic year 2016-17 with additional intake of fifty.
2.
At the time of admission of the writ petition on 23.06.2016, this Court in WPMP.No.24128 of 2016 granted interim direction to the 2nd respondent to consider the application of the petitioner for running the above said course, as prayed for, in accordance with law.
3.
A counter is came to be filed by the 2nd respondent stating that the writ petition is filed seeking relief contrary to Regulation 7(2)(b), and any order against NCTE would amount to directing the NCTE to violate its own Regulations, and therefore prayed for dismissal of the writ petition, and to vacate the above said interim direction granted on 23.06.2016.
4.
In view of the above, and since the academic year is over, nothing survives for adjudication in the writ petition. Therefore,
the writ petition is disposed of, giving liberty to the petitioner to make a fresh application for future academic years. As a sequel, the miscellaneous petitions, if any pending, shall stand closed accordingly. There shall be no order as to costs. ___________________ C. PRAVEEN KUMAR, J Dt.12..07..2017 kv
