HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.28694 of 2016 ORDER:
This writ petition is filed challenging the impugned notice dated 07-07-2016 issued by the 2nd respondent in R.C.No.305 of 2016, wherein directed the 3rd respondent to take action against unauthorized occupations. In pursuant to the said notice, the 3rd respondent passed order dated 09-08-2016 directing the petitioner to vacate the subject land.
Now, learned Standing counsel for the 3rd respondent says that already action is taken in pursuance to the impugned notice and eviction orders are passed. The petitioner preferred appeal before the 4th respondent against said eviction orders and according to both counsel the appeal is pending. When once already action has been initiated in pursuance to the impugned notice and eviction orders are passed, the petitioner preferred appeal, the question of challenging the said proceedings in the writ petition does not arise as already notice worked out. However, since it is stated that appeal filed by the petitioner is pending before the 4th respondent, the 4th respondent is directed to dispose of the appeal filed by the petitioner, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Till the disposal of appeal, interim stay of demolition granted on 24-08-2016 in this writ petition shall continue.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
