This writ petition is filed challenging the provisional assessment notice dated 04-06-2019, wherein and whereby petitioner was provisionally assessed to pay an amount of Rs.1,87,121/- and he was asked to pay 50% of the same for restoring power supply and balance in two installments. Aggrieved by the same, the present writ petition is filed.
Heard learned counsel for the petitioner, who submits that the petitioner is not at fault and no theft of energy took place in his premises and the petitioner will be able to substantiate his claim when civil liability is determined under Section 154 of the Electricity Act (for short "the Act").
Heard Sri R.Vinod Reddy, learned Standing Counsel for respondents.
In view of the facts and circumstances of the case, there shall be direction to respondents to restore power supply forthwith on condition of petitioner paying 50% of the demanded amount i.e. Rs.46,780-25 paise and the same will be subject to further determination of civil liability under Section 154 of the Act and the competent authority who determines civil liability is entitled to conduct enquiry and pass orders.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
