HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.11250 of 2015 O R D E R :

The petitioner, who is accused No.1 in crime No.294 of 2014 of Samalkot Police Station, East Godavari District, registered for the offences punishable under Section 498(A) I.P.C. and Sections 3 & 4 of Dowry Prohibition Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The investigation in this case was completed and charge-sheet was also filed in C.C.No.499 of 2015.

It is the case of the petitioner that he is not aware of the pendency of the case and staying in United States of America. Learned Public Prosecutor submitted that warrants are pending and Look Out Notice was also issued.

Considering the facts and circumstances of the case and also the fact that the petitioner is ready to face the trial before the concerned court, the petitioner is directed to appear before the concerned Court and file an application to recall the warrant and on such application, the trial Court is directed to recall the warrant on the same day on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate and also accept the petitioner to surrender before the Court. The operation of the Look Out Notice issued by the concerned authority is hereby stayed until further orders. Further, the petitioneraccused No.1 is directed to report before the trial Court on all hearing days.

With the above observation, the Criminal Petition is disposed of.
