HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4259 OF 2018 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioner/accused seeking to quash the proceedings against him in C.C.No.22 of 2018 on the file of Judicial Magistrate of First Class, Manthani, wherein in Crime No.4 of 2018 of Kamanpur, cognizance was taken for the offences under Sections 504, 323 and 506 I.P.C. Heard the learned counsel for petitioner and the learned Additional Public Prosecutor.
Having regard to the fact that cognizance was taken and case was registered as C.C.No.22 of 2018 and the matter is coming up for framing charges, this Court is of the considered view that it is not apt to quash the proceedings.
Hence, on request of the learned counsel for the petitioner, liberty is given to him to file suitable application seeking his discharge, in which case, the trial court shall pass appropriate orders on merits expeditiously. Also considering the counsel's request, attendance of petitioner/accused, after first appearance before the trial court, is dispensed with except on the occasions when the trial court requires his attendance.
Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending if any, shall stand closed.
