2. The grievance of the petitioner is that though she is temporarily appointed as fair price shop dealer with regard to Shop No.3 in Narpala Mandal, she has not been given essential commodities in spite of tendering of D.D. Petitioner states that she has already made a representation on 03.01.2015 to the Revenue Divisional Officer requesting to receive the D.D. and to direct respondent No.4 to release the essential commodities.
3. Learned Government Pleader for Civil Supplies, on instructions,
submits that petitioner was temporarily appointed as a dealer in the place of regular dealer, who was under suspension. Petitioner was also supplied commodities upto June, 2014, however, from July, 2014 onwards, it is alleged that petitioner has not turned up and neither submitted D.Ds nor has received the food grains. Hence, as an alternative arrangement, the food grains for shop No.3 are being supplied to another permanent dealer, who was entrusted with the said shop, as a temporary measure.
4. Learned counsel for the petitioner states that right from July, 2014 onwards though petitioner is tendering the D.Ds., they are not accepted and food grains are not supplied in spite of her representation.
5. It is apparent from the instructions, as above, that so far no appropriate arrangement is made with regard to the shop and petitioner continued as a temporary dealer upto June, 2014. Whatever the reasons for non-supply of essential commodities from July, 2014 onwards, since the petitioner is prepared and willing to continue as temporary dealer, petitioner is permitted to make a detailed representation to the respondent No.3 in terms of her appointment as a temporary dealer for the very same shop. If such a representation is received, respondent No.3 shall consider the same and pass appropriate orders expeditiously within two weeks from the date of receipt of copy of representation.
With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
