THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU A.S.No.3025 of 1999 JUDGMENT:

Both the learned counsel are present. It is submitted that the main contesting respondents, viz., Respondents 1, 4 and 5 have already died. Appeal against Respondents Nos.7 & 8 was dismissed for default on 06.04.2006.

Learned counsel for the appellant submits that despite a letter addressed to the appellant for instructions to bring on record the legal representatives of the deceased respondents, there was no response from the appellant.

Sri P.Gopal Das, learned counsel for the remaining respondents submits that the sole appellant also died.

Despite the matter is listed under the caption "for dismissal" the appellant has not come forward to prosecute the matter, as he reported died.

Therefore, the Appeal is dismissed as abated. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
