Though the writ is filed to declare the action of the 3rd respondent in interfering with the construction activities of the petitioner in respect of the plot Nos.1, 2, 3, 4, 5, 6, 7, 8, 9, 10 & 11 in Sy.No.125, Block No.01 to the extent of 336.11 gts., situate at Thirumalapur Village, Shankarampet Gram Panchayath and Mandal, Medak District as illegal and arbitrary and consequently, direct the 3rd respondent not to interfere with the petitioner's construction activity without passing any orders on the application dated 21.06.2019 filed by petitioner for building permission, the learned counsel for the petitioner submitted that the 3rd respondent may be directed to consider the application of the petitioner dated 21.06.2019 for grant of building permission, before whom it is pending. Learned Standing Counsel for the 3rd respondent submitted that for the construction of commercial complex, the Gram Panchayath is not the competent authority to grant permission.

In view of the above, it is sufficient if the 3rd respondent is directed to dispose of the application filed by the petitioner, instead of keeping the same pending.

Accordingly, the writ petition is disposed of directing the 3rd respondent to consider the application dated 21.06.2019 filed by the petitioner and pass appropriate orders in accordance with law within a period of two (2) weeks from the date of receipt of a copy of this order, and communicate the same to the petitioner.
