THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12291 of 2018 ORDER:

In this writ petition, under Article 226 of the Constitution of India, the grievance of the writ petitioner firm is with regard to the non disposal of the appeal preferred by it, on 11.01.2018, within the time stipulated in the orders, dated 21.12.2017, of this Court passed in WP.No.28207 of 2017. Learned counsel for the petitioner would submit as follows: - 'The petitioner preferred an appeal within the time stipulated in the afore-said orders of this Court. The said appeal was entertained; however, the said appeal was not disposed of as per the afore-said orders of this Court within a period of two months from the date of receipt of appeal by the appellate authority. In that view of the matter, the interim order granted, on 23.08.

2017, which was directed to be maintained for a period of four months from the date of the afore-stated orders in the writ petition and which is coming to an end by 21.04.2018 is staring at the petitioner; and, the petitioner, therefore, apprehends prejudice to its interests in the matter.' Learned standing counsel appearing for the respondents 1 to 3 would submit that since the appeal is filed within time and is entertained, the appellate authority would dispose of the same and that to protect the interests of the petitioner till such time, the interim order which was directed to be maintained for a period of four months and which is coming to an end by 21.04.2018 may be extended for a period of three months within which the appellate authority would dispose of the appeal of the petitioner.

expeditiously as possible and preferably within three months from the date of receipt of a copy of this order. The interim order granted, on 23.08.2017, and which was directed to be maintained for a period of four months from 21.12.2017 and which is coming to an end by 21.04.2018, shall stand extended from 21.04.2018 for a period of four months or till the disposal of the appeal, whichever is earlier.

There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
