THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34073 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of shop No.1925 of Jagtial Village and Mandal of Karimnagar District. The shop was inspected on 12.08.2015 and noticing some variation in the stock, proceedings under Section 6A of the Essential Commodities Act were initiated and they are pending. The second respondent issued a show cause notice on 29.08.2015 and the petitioner submitted her reply on 03.09.2015. After considering the reply, the second respondent passed an order on 07.10.2015 suspending the authorisation of the petitioner. Challenging the same, the present Writ Petition is filed. In view of the allegation of diversion of rice and sugar into black market, this Court is not inclined to admit the present Writ Petition. However, the second respondent is directed to conduct an enquiry by giving due opportunity to the petitioner and pass final orders thereon, within a period of sixty days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 13.10.2015
