HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12387 OF 2017 ORDER:

This writ petition is filed challenging the notice dated 21.03.2017 issued by the 4th respondent in letter No.A/252/2017 wherein the petitioner was asked to restore the tank bund i.e. Kommalavani Gunta, since he destroyed the same, otherwise action will be initiated as per law. In pursuance of the said notice the petitioner submitted explanation on 24.03.2017, stating that the subject land is a patta land and that there is no government land as alleged in the notice. But, without passing any orders on the same, the respondents are trying to take coercive steps against the petitioner. Aggrieved by the same, present writ petition is filed. Heard both sides.

In view of the aforesaid facts and circumstances, the 4th respondent is directed to consider the explanation of the petitioner and pass final orders after affording opportunity of hearing to the petitioner. Till passing of final orders, no coercive steps shall be taken against the petitioner.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
