Nandigam Suvarthamma, v. Government Of Andhra Pradesh,
HON'BLE SRI JUSTICE S.V.BHATT W.P. No.29600 OF 2012 ORDER:
The petitioner challenges the unilateral cancellation of Gift Deed dated 06.02.2012 through Cancellation Deed No.3502 of 2012 dated 18.05.2012, as illegal and contrary to the provisions of the Registration Act and the Rules framed thereunder.
Counsel appearing for the parties fairly state that the grievance of petitioner is squarely covered by the decisions of the Apex Court and this Court in Thota Ganga Laxmi v. Government of Andhra Pradesh[1] and Garagaboyina Radhakrishna v. the District Registrar[2]. I have perused the Revocation Deed No.3502 of 2012. Prima facie, it appears the 5th respondent unilaterally revoked the Gift Deed dated 06.02.2012. Having regard to the principles laid down in the decisions referred to above, the unilateral cancellation is illegal. The writ petition is ordered by setting aside the Revocation Deed No.3502 of 2012. No order as to costs.
Miscellaneous petitions pending if any shall stand closed. _ S.V.BHATT, J Date:08.08.2016 Stp [1] 2012 (1) ALD 90 (SC) [2] 2012 (2) L.S. 242.
