Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1 and Sri S. Prabhakar Reddy, learned standing counsel for GHMC for respondents 2 and 3. With the consent of both the learned counsel, the writ petition is disposed of. 2.

This writ petition is filed alleging that respondent No.4 is making illegal construction in property bearing Plot No.30 to an extent of 200 sq. yards in Survey Nos.109 and 110 of Amangal Village, Hayathnagar Mandal, Ranga Reddy District, and in spite of filing complaints against the said illegal construction, no action is taken by the respondent - Corporation.

Learned standing counsel for GHMC, on instructions, submits that having noticed that illegal construction is carried out by the unofficial respondent, notices under Section 452 and 636 of the Greater Hyderabad Municipal Corporation Act, 1955 were issued and at that stage, the unofficial respondent filed O.S.No.1648 of 2019 in the Court of VIII Additional Senior Civil Judge, Ranga Reddy District at L.B. Nagar. The unofficial respondent also filed I.A.No.706 of 2019 and the trial Court granted order of status quo. Learned standing counsel submits that therefore, no further action could be taken by the respondent - Corporation. However, he informs the Court that no further construction activity is taken up by the unofficial respondent.

Recording the said submission, the Writ Petition is disposed of granting liberty to the respondent - Corporation to file vacate stay petition against the injunction order granted by the trial Court and pending consideration of the vacate petition, if any, the respondent - Corporation shall ensure that no further construction is taken up by the unofficial respondent. Miscellaneous petitions, if any, shall stand closed.
