ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.33 of 2026 of Khairatabad Police Station,
Hyderabad. The offences alleged against the petitioner are punishable under Sections125, read with Section 3(5) of BNS, Section 77 of JJ Act and Section 11 read with Section 12 of POCSO Act.

The case of the prosecution is that the de facto complainant lodged a complaint before the Police on 01.02.2026 stating that his younger daughter was aged 17 years. On 31.01.2026, she left home by informing that she is going to college to attend practical examination. At that time the complainant was out of station and got a phone call from the college bus driver that his daughter did not come for boarding the bus. Immediately the complainant called his wife and asked about his daughter. Then the complainant's wife informed that their daughter went to college. At about 08:40 A.M. the complainant called to the college and asked that there his daughter attended the college, the college staff replied that his daughter came to the college and to confirm once again at 11:40 A.M. made another call to the college, then the college staff replied that his daughter had not attended the college. During the mid-night at about 01:30 A.M. on 01.02.2026, came to know that his daughter was on
the terrace. By that time, the complainant came, his younger daughter was lying on the ground with bleeding injuries. On enquiry, the complainant came to know that his younger daughter did not go to the college on 31.01.2026, but went to the petitioner house and further noticed that the petitioner gave toddy to his daughter. Based on the said complaint, Crime No.33 of 2026 was registered for the above said offence. 3.
Heard Sri J.Naresh Kumar, learned counsel appearing on behalf of the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State 4.
Learned counsel for the petitioner submitted that the petitioner is in jail since 02.02.2026 and the investigation is still pending. It is further submitted that the other accused in the present crime were issued notice under Section 35(3) of BNSS, whereas the petitioner alone has been arrested and kept in custody and prays this Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the petition, submitting that the alleged offences
against the petitioner are serious and heinous in nature and the investigation is under progress. As such, the petitioner is not entitled for bail and prays this Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 02.02.2026 and that investigation is under progress.
Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the I Additional Judicial Magistrate, Nampally.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8)
week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
