THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3725 OF 2022 O R D E R:

This criminal petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused No.2 on bail in connection with Crime No.326 of 2021 on the file of Falaknuma Police Station, Hyderabad registered for the offence punishable under Section 8(c) read with Section 20 B and 27 of NDPS Act.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that, the police on 15.12.2021 found accused No.1 and 2 and when they tried to escape, the police caught hold them. They were taken before a Gazetted Officer to be checked in accordance with Sec.50 of N.D.P.S. Act. Two liters of Hashish Oil was found on the person of accused No.1 and cell phones from the possession of both were recovered according to the remand report. When it is specifically mentioned in the remand report that upon checking in the presence of Gazetted Officer, two

liters of Hashish oil was found in possession of accused No.1, the present petitioner can be granted the relief of bail from whom only cell phone was seized.

In the said circumstances, the petitioner/Accused No.2 is directed to be released on bail on his furnishing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for like sum.

Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
