HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos. 19835 and 19836 of 2007 COMMON ORDER:

Both the writ petitions are filed seeking a writ of mandamus to declare the inspection dated 22.08.2007 conducted by the officials of the 1st respondent as illegal and arbitrary. A consequential direction is also sought to set aside the notice Nos.ADE/OP/D-23/C-1D.No.773 and ADE/OP/D-23/C-1D.No.774, dated 24.08.2007, of the 3rd respondent.

Heard Mr. Duba V. Nagarjuna Babu, learned counsel for the petitioner, and Mr. V. Ajay Kumar, learned standing counsel for AP Transco, appearing for the respondents.

When the matters are taken up for hearing, learned standing counsel for the respondents submits that since the matters relate to theft of energy, they may be referred to the Special Court constituted under Section 154 of the Indian Electricity Act, 2003. 4.

In view of the submission made by the learned standing counsel, the writ petition is disposed of directing the respondents to refer the case of the petitioner to the Special Court constituted under Section 154 of the Indian Electricity Act, 2003. The payment of balance of provisionally assessed amount will be subject to the outcome of the proceedings before the Special Court.
