The petition coming on for hearing, upon perusing the Petition and order of the High Court dated 6.10.2020 and upon hearing the arguments of MR.K.SURENDER Advocate lor the Petitioner and PUBLIC PROSECUTOR for Respondent, the Court made the following.
ORDER
This application is Iiled seeking to relax the condition No.2 imposed by this Court in the order dated 06.10.2020 in Cr1.P.No.4533 of 2O2O. The peLitioners are accused Nos.l and 3 in Crime No. 761 of 2O2O pending on the file of Station Houge Oflicer, NTPC, Ramagundem District. The offences alleged against the petitioners herein are under Sections 306 read with 34 of IPC.
This Court vide order dated 06. 10.2020 granted regular bail to the petitioners herein on certain conditions including the condition of petitioners appear before the Station House Officer concerned on every day between 10.00 AM and 5.00 PM till completion of investigation and filing of charge sheet. Now the learned counsel for the petitioners would submit that the petitioners have been complying with the orders of this Court and there are no allegations of violation of any of the conditions imposed by this Court.
On instructions, learned Public Prosecutor, would submit that the investigation is pending and statements of some witnesses have to be recorded. Considering the above, this application is orde red modifying the said condition imposed by this Court vide order dated 06.10.2020 in Cr1.P.No.4533 of 2O2O that the petitioners to appear before the Station House Officer, NTPC, Ramagundam District on 1"t Sunday of every month between 10.00 AM and 05.00 PM till completion of investigation and filing of charge sheet. However, it is made clear that other conditions imposed by this Court in Cr1.P.No.4533 of 2020 shall remain unaltered. '{he petitioners shall co-operate with the Investigating Officer by appearing before him as and when their presence is required.
