THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.7384 of 2016 ORDER:
The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, the Petitioners herein prays that this Hon'ble Court may be pleased to issue a writ more in the nature of writ of Mandamus declaring the action of the Respondents in notifying Petitioners lands situated at Sy.No's.29/A1, 29/B1 an extent of Ac.2-02 Cents in Sy.No's. 25/1, 25/2, an extent of Ac. 0-41 Cents total Ac.2-43 Cents and in Sy.No's. 22A, 22B an extent of Ac.7- 37.50 cents and Sy.No's. 23B3A, 23B3B an extent of Ac.0-50 Cents total Ac.7-87.5 Cents, together totaling to extent of Ac.10-30.
50 Cents situated at Undavalli Village, Tadepalli Mandal, Guntur District from Residential Zone to Open Space and Recreation (Passive Zone) and Recreation Zone to Passive Zone respectively in the Draft Capital City Master Plans - Parts 1 and 2, dated 22.07.2015 and 26.12.2015 as illegal, arbitrary, unjust, violative of principles of natural justice, violative of fundamental rights guaranteed under Constitution of India, and the Constitutional Right guaranteed under Article 300-A, and pass such other order or orders as are deemed fit and proper in the circumstances of the case."
It appears that the petitioners' representations dated 13.10.2015 and 02.01.2016 airing their grievance are pending consideration before the Andhra Pradesh Capital Region Development Authority, the third respondent.
As the scheme of the Andhra Pradesh Capital Region Development Authority Act, 2014, permits the third respondent Authority to entertain and act upon the objections filed by the public, the writ petition is disposed of directing the third respondent Authority to consider the objections as put forth in the petitioners' representations dated 13.10.2015 and 02.01.2016 and take appropriate action thereon in accordance with law, if warranted. Pending miscellaneous petitions, if any, shall stand closed in
