Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Against Geddapu Lakshmi Prasad, working as Commissioner of Commercial Taxes, Andhra Pradesh, FIR No.02 of 2018 was registered on 27.01.2018 under Section 13 (2) r/w. 13 (1) (e) of Prevention of Corruption Act, 1988. In the process of investigation, the ACB requested to freeze the accounts of all near relatives of accused officer. Petitioner claims to be the sister of second wife-Mallika of the accused officer, who is working as School Assistant. Petitioner claims that she had savings bank account bearing No.62031397453 and two recurring deposit accounts in State Bank of India, Ashok Nagar Branch, Hyderabad. 3.
According to learned counsel for the petitioner, salary of the petitioner is deposited into the S.B.Account and because of freezing of the S.B.Account, petitioner is unable to draw the salary causing lot of hardship and suffering. Learned counsel for the petitioner sought leave of the Court to withdraw the salary credited to the account of the petitioner.

Learned Standing counsel, on instructions, fairly submits that the ACB has no objection for withdrawal of the salary deposited every month, but cannot withdraw any other amounts until the investigation is completed and cannot operate other accounts.

At this stage, both counsels agree for disposal of the writ petition, permitting the petitioner to withdraw the salary amount credited to the account mentioned above.

Having regard to the above submissions, the Writ Petition is disposed of directing the Branch Manager, State Bank of India, Ashok Nagar Brnach-4th respondent to permit the petitioner to withdraw the salary amount credit to her S.B.Account bearing No. 62031397453 only. It is made clear that the Bank shall not allow the petitioner to withdraw any other amounts or to operate any other account without leave of the ACB. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
