THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2071 of 2012 ORDER:
The petitioner preferred the present Criminal Revision Case by invoking provisions under Sections 397 r/w.401 of the Code of Criminal Procedure being aggrieved by the order, dated 15.05.2012, passed in Crl.MP. No.62 of 2010 by the Family Court, Prakasam at Ongole.
Heard and perused the material available on record. On 19.10.2012, while ordering notice to the respondents 1 to 3, this Court granted interim stay of the order under challenge, on condition of petitioner depositing the entire arrears of maintenance, calculating at Rs.1,500/- each to the respondents 1 to 3, in five equal instalments and also continuing to pay the maintenance at the same rate on or before 10th of every succeeding month till disposal of this revision. When the matter is taken up for hearing, learned counsel appearing for the respondents 1 to 3 submitted that the petitioner has not complied with the interim order passed by this Court and he is not paying any amount towards interim maintenance to the respondents 1 to 3.
In view of non-compliance of the interim order passed by this Court on 19.10.2012, this Court is not inclined to grant the relief sought for by the petitioner.
Accordingly, the Criminal Revision Case is dismissed. Miscellaneous applications, pending if any, shall stand closed. _______________ RAJA ELANGO, J July 27, 2016.
