Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents. The petitioner was appointed as fair price shop dealer of shop

No.30 situated at Proddatur Town and Mandal, Y.S.R. Kadapa District in the year 2007 under Scheduled Caste category. An e-pass machine was supplied to the petitioner in the month of April, 2015, however, it did not work properly. The Vigilance and Enforcement Team inspected the shop of the petitioner on 18.04.2015 and found some variation in the stock. Proceedings under Section 6-A of the Essential Commodities Act were initiated in respect of the said variation and they are pending. While so, a show cause notice was issued on 30.04.2015, to which the petitioner submitted her explanation on 13.05.2015. After receiving the explanation, the authorization of the petitioner was suspended by the third respondent-Revenue Divisional Officer, Jammalamadugu, through proceedings dated 20.05.2015. Challenging the same, the present writ petition is filed.

There are four allegations levelled against the petitioner and the petitioner submitted her explanation also, but the enquiry is not completed by the third respondent so far.

In the circumstances, this Court is not inclined to interfere with the pending enquiry. However, the third respondent is directed to conduct enquiry after giving opportunity to the petitioner and complete the same within a period of 30 days from the date of receipt of a copy of this order. With the above directions, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
