THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11369 OF 2015 ORDER:

1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners / A.1 to A.6 in C.C.No.267 of 2015 on the file of Judicial Magistrate of First Class, Venkatagiri, SPSR Nellore District.

2 When the matter is taken up for hearing, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw the petition. He further requested the Court to dispense with the presence of the petitioners before the trial Court on each and every date of adjournment.

3 There is no dispute with regard to the identity of the petitioner Nos.2 to 6 who are accused Nos.2 to 6 in C.C.No.267 of 2015 before the Court below. Even if the presence of the petitioner Nos.2 to 6 is dispensed with, no prejudice will be caused to the 2nd respondent. Accordingly, this criminal petition is dismissed as withdrawn, by dispensing with the presence of the petitioner Nos.2 to 6 who are accused Nos.2 to 6 in C.C.No.267 of 2015 on the file of Judicial Magistrate of First Class, Venkatagiri, SPSR Nellore District on each and every date of adjournment. However, they shall appear before the trial Court as and when his presence so required.
