When the matter is taken up for hearing, learned counsel for the appellant states that by mistake this appeal is filed before this Court, though the appeal lies before the District Court as the valuation is less than Rs.10 lakhs. Hence, the learned counsel seeks permission to withdraw the appeal with liberty to file appeal before the appropriate Court.

Permission to withdraw the appeal is accorded, with liberty as sought for.

The Registry is directed to return the original papers to the counsel for the appellant.

Accordingly, the appeal is dismissed as withdrawn. No costs. Miscellaneous petitions, if any pending in this appeal, shall stand closed.
