HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 7065 of 2016 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Home.

The grievance of the petitioner is that the respondents are interfering with the civil rights of the petitioner by threatening her to vacate house bearing Door No.1-35-173/A situated at Naibrahmin Colony, Maruthinagar, Guntur.

The Government Pleader for Home placed on record the written instructions received from the office of Inspector of Police, Pattabhipuram Police Station, Guntur District, wherein the respondents-police denied their interference in the civil dispute. Apart from that they brought to the notice of the Court about the registration of five crimes against Shaik Bibi Asha for collecting amount from the general public in the name of chits and then committing default in payment of chit amount after completing the chit period. The petitioner claims that the accused in the above five crimes i.e., Shaik Bibi Asha sold the house and got registered in her name, but the said house is constructed in B-Form patta land. Burraiah also claims to have purchased the said property from the said Shaik Bibi Asha and it is he who is claiming right over the property. In view of the above, it is strenuously contended by the Government Pleader that the police are not interfering with the civil rights of the petitioner over the said property.

there shall be a direction to the respondent police authorities to be mindful of the limits of their jurisdiction in criminal law and not to interfere with any civil dispute. Any action sought to be taken by the respondent police authorities shall be done in accordance with law.

With the above direction, the writ petition is disposed of. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
