THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21753 of 2016 ORDER :
This Writ Petition came to be filed with the following prayer:
"...to issue a suitable writ order or direction more particularly one in the nature of Writ of Certiorari by call for the records pertaining to CC 287/2007 on the file of the Judicial First Class Magistrate, Rajam and quash the same and pass.."
2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for the respondents. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.
3. Though various grounds are urged in the Writ Petition, learned counsel for the petitioner submits that though C.C. No.287 of 2007 was of the year 2007, the petitioner is being summoned to police station without any reason. Learned Assistant Government Pleader appearing for the respondents, on instructions, states that the allegations made in the Writ Petition are false and that the police would follow due process of law to summon the petitioner to police station if she is required in any case. Recording the said statement, the respondent No.1 is directed not to summon the petitioner to police station without following due process of law.
4. The Writ Petition is disposed of with the aforesaid direction. It is made clear that this order shall not preclude the petitioner from availing the remedies available under law. Miscellaneous petitions pending, if any, in the Writ
Petition shall stand closed in the light of this final order. No order as to costs.
