This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: " ... declaring the action of the 4th respondent in not taking action against the respondent No.9 who is illegally erecting flags and abstaining the rights of the petitioner' Sangham spread across in Sy.No.196 admeasuring Ac.5.00 at Thampara (Swamp) of Manikyapuram given 'D' patta for Ac.5.00 as arbitrary, illegal ......"
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue and learned Assistant Government Pleader for Fisheries.
Since this Court is not going into the merits of the case, there is no necessity to issue notice to R-9. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the representation submitted by the petitioner on 17.07.2017.
Learned AGP submits that the 4th respondent may be directed to dispose of the representation submitted by the petitioner.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-The District Collector, Srikakulam, to deal with the representation submitted
by the petitioner on 17.07.2017 seeking to take action against R-9, at the earliest.
