ORDER:

Heard.

The grievance of the petitioners is that they have been granted DKT patta with regard to Acs.2.61 cents of land in Survey Nos.102/25 and 102/34 of Motupalli Village, Chinaganjam Mandal, Prakasam District. Since then, they have been in possession and enjoyment of the said property and are cultivating the said land. Alleging that the 1st respondent along with his subordinates visited the lands on 13.06.2014 and threatened the petitioners to vacate the same, this Writ Petition is filed.

Learned Government Pleader for Revenue, on instructions, submits that the Sand Sub-committee Members have inspected certain lands in Motupalli Village to identify sand reaches under new sand policy of the Government and various lands were identified and appropriate report is submitted to the Revenue Divisional Officer, Ongole. However, the land claimed by the petitioners in the Writ Petition is not proposed for excavation of the land under new policy of the Government. The allegation of the petitioners is denied and it is stated that none of the officials of the Revenue Department have directed the petitioners to vacate the land or threatened them to evict from the land.

It is also stated that there is no proposal to evict the petitioners from the land in question and if at all the petitioners land is required for any public purpose, the respondents shall follow due process of law. In view of the same, since there is no threat and the petitioners have filed this Writ Petition only on apprehension, no further orders are called for. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
