THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7525 of 2016 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.38 of 2016 of Shanthinagar Police Station, Mahaboobnagar District, registered for the offences punishable under sections 307, 341, 504, 506 r/w.34 IPC.
Heard the learned counsel appearing for the petitioners/A1 to A4 and the learned Additional Public Prosecutor, representing the State.
It is alleged in the complaint that prior to the date of offence, the de facto complainant asked for return of money incurred towards development of church in the village and in that connection, the petitioners asked the de facto complainant to withdraw his request, otherwise they would kill him and accordingly, on 06.05.2016 the petitioners attacked the de facto complainant armed with deadly weapons and caused him injuries.
There are specific allegations made against the petitioners/A1 to A4, which, prima facie, reveal the commission of offences, as alleged. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report. In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioners/A1 to A4 in the above crime, till the investigation is completed and the charge sheet is filed. Pending miscellaneous applications, if any, shall stand closed in consequence.
