HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2578 of 2017 ORDER :
This criminal petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') to enlarge the petitioner/A.4 on bail in the event of her arrest in connection with Crime No.02/RC-CIU-ACB/2017 of Anti-Corruption Bureau, C.I.U., A.P., Vijayawada, registered for the offence punishable under Sections 13(1)(e) read with Section 13(2) of the Prevention of Corruption Act, 1988.

Sri Vinod Kumar Desh Pande, learned counsel for petitioner, submitted that as the petitioner is the owner of various items of the property concerned, the petitioner received a notice under Section 41A of Cr.P.C., but she could not appear before the Investigating Agency strictly adhering to the requirement under Section 41-A of Cr.P.C. as she was admitted in hospital. Learned counsel for the petitioner would further submit that the petitioner is now ready to appear before the police in pursuance of notice under Section 41-A of Cr.P.C.

Sri Udaya Bhaskar Rao, learned Standing Counsel for ACB and Special Public Prosecutor, opposed the petition, however permitted the petitioner to appear before the police in pursuance of the notice under Section 41-A of Cr.P.C. by fixing a date and time without granting any order cannot be denied.

Acceding to the request of the learned counsel for the petitioner and learned Standing Counsel for ACB, this Court, instead of granting pre-arrest bail, directing the petitioner to appear before the C.I.U. Unit, ACB, Vijayawada, on 12.04.2017 at 12.00 Noon and further directed to appear before the Station House Officer, ACB, CIU, Vijayawada, for the purpose of investigation, as and when directed by the Investigating Officer so as to complete the investigation as early as possible.

With the above observation, the Criminal Petition is disposed of.
