HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41321 of 2015 ORDER:

Heard Sri V.Narsimha Goud, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel appearing for the respondents.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not adding the (20) years of stagnation increment with effect from 01.08.2009 as per circular No.PD.4/2011, dated 12.01.2011 in spite of the direction of this Court passed in W.P.No.26028 of 2012, as arbitrary, discriminatory and in violation of Articles 14, 16 and 21 of the Constitution of India; and consequently to direct the respondents to re-fix the pay by adding (20) years of stagnation increment from 01.08.2009, arrange its consequential benefits including difference of retirement service benefits ie. Gratuity, Provident Fund and Earned Leave etc. along with interest @ 18% per annum.

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents

Corporation to consider his representation, dated 02.05.2013, in accordance with law.

Learned Standing Counsel appearing for the respondents Corporation submits that the petitioner has already made an application pursuant to an order passed by this Court in W.P.No.26028 of 2012 and the same may be directed to be considered in accordance with law.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the writ petition is disposed of at the admission stage, directing the respondents to consider the representation, dated 02.05.2013, made by the petitioner, in accordance with law, at the earliest, if the same is still pending consideration.

There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
