HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24943 OF 2017 ORDER:

The inaction of respondent Nos.2 to 4, in registering the petitioner's complaint dated 09.01.2017, is questioned in the Writ Petition as being illegal and arbitrary. Learned Government Pleader for Home (AP), on instructions, would submit that, based on the complaint given to the Superintendent of Police, Prakasam District (respondent No.2), investigation was ordered and, in the process of investigation, the investigation officer visited Church and, having found that prayers are being conducted peacefully, had submitted report to respondent No.2. She further submits that preliminary enquiry revealed that there were certain property disputes between the petitioner and others and investigation officer is in the process of filing report under Section 173(2) Cr.P.C, a copy of which is made available to the learned counsel for the petitioner.

In the light of the submissions of the learned Government Pleader for Home (AP) that action had already been initiated on the petitioner's complaint, there shall be a direction to respondent No.4 to take necessary steps to file a report under Section 173(2) Cr.P.C.

The Writ Petition is, accordingly, disposed of. No order as to costs.

Consequently, the miscellaneous applications, if any, shall stand closed.
