HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 28857 of 2011 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioner contends that petitioner was appointed as conductor on 09.06.1997 and her services were regularized on 01.08.1998. Thereafter, she has been promoted as Traffic Inspector-III on 09.02.2009. While she was in service, she was imposed with 16 punishments ranging from stoppage of increments without cumulative effect for different charges. Even after completion of the punishment period, the respondents have not restored the increments, which ought to have been released as per the rules. He further submits that the petitioner has retired from service in the month of May, 2018 and a direction be issued to the respondents to release the increments which were stopped after the currency of punishment period.

Learned Standing counsel appearing for the respondents contended that currency of punishment had expired on 01.03.2015 and thereafter, the respondents have released the increments in accordance with rules. Therefore, the cause in the writ petition does not survive and the same is liable to be dismissed.

This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a representation to the respondents seeking release of increments, if not already paid within one week from the date of receipt of copy of this order. Upon receipt of such representation, the respondents shall consider the same and pass appropriate orders within four weeks thereafter.

With the above observations, writ petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
