This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.1, for grant of anticipatory bail in Crime No.729 of 2018 of Jubilee Hills Police Station, Hyderabad, registered for the offences punishable under Sections 328 and 188 of IPC and Section 4 and 20(2) of COTP, Act, 2003. 2.

Heard learned counsel for the petitioner/ A.1, learned Additional Public Prosecutor representing the respondent/ State and perused the record.

Learned counsel for the petitioner/ A.1 submits that the petitioner did not commit any offences and the allegations levelled against him are false. The petitioner has old aged parents. The petitioner is ready to abide by any conditions imposed by the Court. Hence, he prayed to grant bail to the petitioner. 4.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner/ A.1. 5.

The material placed on record reveals that the petitioner is illegally running the Hookah centre by violating the rules laid down by the concerned authorities. The allegations levelled against the petitioner are serious and severe in nature. Hence, he is not entitled for anticipatory bail.

Accordingly, the Criminal Petition is dismissed. However, if the petitioner/ A.1 surrenders before the Court below concerned and

move an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the same may be considered in accordance with law.
