THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 5823 of 2017 ORDER:
Petitioner filed the present writ petition challenging the action of respondent Nos.4 to 6 in calling him to their offices without there being any complaint against him.
Earlier, the petitioner filed W.P.No.39199 of 2016 and this Court disposed of the same on 14.11.2016 directing the respondents therein not to call the petitioner to the Police Station without registration of any crime against him.
Now, the learned Government Pleader for Home, on the basis of written instructions, submits that the Sub-Inspector of Police, Penamaluru Police Station, Vijayawada, registered Crime No.57 of 2017, dated 27.01.2017, against the petitioner and another for the offence punishable under Section 420 IPC and that the investigation is under progress. So far, four witnesses were examined and the Investigating Officer is taking steps for issuing notice under Section 41 (A) Cr.P.C. to the accused. However, with regard to the Special Operation Team, Amberpet, Rachakonda Commissionerate, it is stated that they have nothing to do with the petitioner, and Crime No.2 of 2017 relates to Chaderghat Police Station, Hyderabad. In view of the same, no further orders are necessary in the present writ petition.
The writ petition is accordingly closed. However, it is open to the Investigating Officer to conduct the investigation in accordance with law.
