HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.9822 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent in suspending the authorisation of the petitioner's fair price shop by his proceedings dated 27.03.2015, as illegal and arbitrary and for a consequential direction to set aside the same.

3. The fair price shop of the petitioner was inspected and certain variations in the stock have been allegedly noticed. Learned counsel appearing for the petitioner submits that the variations found are minor which do not warrant suspension of the authorisation. On the other hand, learned Government Pleader would contend that the variations in the stock of rice are not minor and that there is allegation against the petitioner that he has been distributing the rice and sugar with lesser quantity to the cardholders. Considering the submissions on either side, this Court is of the opinion that an enquiry into the allegations has to be conducted by the Revenue Divisional Officer, Kadiri.

4. Under these circumstances, the 2nd respondent-Revenue Divisional Officer, Kadiri, is directed to conduct enquiry into the allegations against the petitioner and pass final orders in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs. __________________
