This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner praying to enlarge him on bail in connection with Crime No.762 of 2025 of Panjagutta Police Station, Hyderabad District. The offences alleged against the petitioner are under Sections 103(1) of Bharatiya Nyaya Sanhita, 2023.

The facts of the case are that the de facto complainant lodged a complaint before police stating that for the past one
and a half year, he had been running a tea stall in the premises of Imperial House Apartments, bearing H.No.6-3-865/A/1, Begumpet, Hyderabad. Adjacent to his tea stall, there are several commercial establishments. There is also a tiffin center named Sri Satya Tiffins & Meals, situated in an L-shaped structure adjoining the corner shop, which is run by one Mr. Yesuraj, who operates the said tiffin center from 8:00 AM to 8:00 PM. The complainant used to run his tea stall from 8:00 AM to 7:00 PM On 23.10.2025 at about 07:21 hours, the complainant received a phone call from the said Yesuraj, who asked him to come to the shop. Immediately, the complainant rushed to the location and noticed a woman lying unconscious in front of the tiffin center run by Yesuraj.
The woman was lying face upwards with visible bleeding injuries on her face and head. The complainant also noticed a quarter bottle of MC liquor and a food packet lying beside her. It is stated that some unknown person might have assaulted the said woman, resulting in her death. Subsequently, he came to know that the deceased was one Jenny Ngaihi @ Leesa, aged about 35 years, who used to roam in the said locality and appeared to be a native of Assam.

Heard Sri B. Kiran Kumar, learned counsel appearing for the petitioner and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The learned counsel for the petitioner contended that the petitioner has been in continuous judicial custody for more than 90 days since his arrest on 24.10.2025, and the investigation has substantially completed and charge sheet has also been filed and all material objects have already been seized and sent for analysis, leaving no scope for tampering. He further submitted that the petitioner is ready and willing to co-operate with the investigation, has no criminal antecedents and that the earlier bail application was dismissed, the present petition is maintainable in view of the prolonged custody and progress in investigation. Hence, prayed this Court to enlarge the petitioner on bail by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the offence committed by the petitioner is a very serious and heinous offence involving rape and murder
of a woman. Hence, petitioner is not entitled to bail and prayed to dismiss this petition.

Having considered the rival submissions and upon perusal of the material on record, it is evident that the petitioner has been in judicial custody since 24.10.2025. Though the learned Additional Public Prosecutor opposed the bail on the ground that the offence is a brutal murder, it is noted that the charge sheet has already been filed and the case is at the stage of P.R.C. There appears to be no likelihood of the trial being concluded in the near future. Taking into consideration the overall facts and circumstances of the case, the progress of investigation, and the period of incarceration, this Court is inclined to grant regular bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned XIV Additional Chief Judicial Magistrate at Nampally, Hyderabad.
ii.
The petitioner shall appear before the concerned SHO between 09.00 a.m. and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge
sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.
