THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.8125 of 2015 ORDER:

In this writ petition, the petitioner challenges the notification dated 28-02-2015, issued by the Tahsildar, Rayadurg, the 4th respondent herein, under the provisions of A.P. Rights in Land and Pattadar Pass Books Act, and pursuant to the same, the petitioner submitted his objections on 17-03-2015. The petitioner submits that his objections would not be considered by the enquiring authority, the 4th respondent. It is also submitted that initially the petitioner filed W.P.No.32988 of 2014 and this Court granted stay of the proceedings. Learned Government Pleader, by pointing out to the notice dated 28-02-2015, submits that the enquiry into subject land is yet to be conducted, and the same is scheduled to be held on 14-04-2015, and there is no basis for the apprehension of the petitioner that his objections would not be considered by the authority, while passing the orders.

In the instant case, the grievance of the petitioner is only a mere apprehension, and in the normal circumstances, no orders need to be passed. However, since the enquiry is scheduled on 14-04-20115, and the petitioner has already submitted his objections on 17-03-2015, the 4th respondent is directed to consider the objections filed by the petitioner, and pass appropriate orders in accordance with law, keeping in view the orders, if any, passed in W.P.No.32988 of 2014, and after giving an opportunity of hearing to the petitioner.

The writ petition is accordingly disposed of.

The miscellaneous petition filed in the writ petition shall also stand disposed of. There shall be no order as to costs.
